This Internal Do Not Call (DNC) and TCPA Compliance Policy governs how Blóm Census and Blóm Capital conduct outbound telephone calls and related sales communications nationwide. This policy applies to all employees, contractors, and representatives involved in calling or texting prospects.
1. Purpose
The purpose of this policy is to ensure compliance with:
- The Telephone Consumer Protection Act (TCPA)
- FTC Telemarketing Sales Rule (TSR)
- Federal and state Do Not Call (DNC) regulations
2. Do Not Call Lists
a. National Do Not Call Registry
- Outbound calls must be scrubbed against the National Do Not Call Registry as required by law.
b. Internal Do Not Call List
- Any individual who requests not to be called must be added to the internal DNC list immediately.
- Internal DNC requests must be honored indefinitely unless the individual provides new consent.
3. Handling Opt‑Out Requests
If a person says:
- “Don’t call me”
- “Stop calling”
- “Take me off your list”
The caller must:
- Stop the call immediately
- Confirm the request politely
- Ensure the number is added to the internal DNC list
- Not attempt further calls or texts to that number
4. Call Time Restrictions
Outbound calls may only be placed:
- Between 8:00 a.m. and 9:00 p.m. local time of the recipient
5. Caller Identification
All outbound calls must:
- Clearly identify the caller and company
- Provide a valid callback number when required
Caller ID spoofing or misleading identification is prohibited.
6. Call Recording
- Calls may be recorded for quality, training, or compliance purposes
- Where required by law, callers must disclose call recording at the start of the call
- Recording must comply with two‑party consent laws where applicable
7. Consent Requirements
- Calls and texts must only be made where valid consent exists or where permitted by law
- Consent records must be stored and retrievable
- Consent does not override DNC requests once made
8. Training & Enforcement
- All sales and marketing personnel must be trained on this policy
- Violations may result in disciplinary action, up to and including termination
9. Recordkeeping
Blóm Census / Blóm Capital will maintain records of:
- Consent where applicable
- DNC requests
- Call and opt‑out logs
